These Terms and Conditions ("Terms") govern your access to and use of the Vanshavali Bhatnagar mobile application and related website services (collectively, the "App"), operated by Vanshavali Bhatnagar ("we," "our," or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Description of the Service
Vanshavali Bhatnagar is a digital family tree platform for the Bhatnagar community, currently available as an Android application (APK). The App allows users to create and manage family profiles, explore lineage, preserve family history, and access community information. Features may change over time as we improve the service.
2. Eligibility
You must be at least 13 years of age to create an account. If you are under the age of majority in your jurisdiction, you may use the App only with the consent and supervision of a parent or legal guardian. By using the App, you represent that you meet these requirements.
3. Accounts and Security
You are responsible for the accuracy of the information you provide when registering and for keeping your login credentials confidential. You must notify us promptly at support@vanshavali.com if you suspect unauthorized access to your account. You are responsible for activity that occurs under your account.
4. Family Data and User Content
You may add names, relationships, photographs, biographical details, and other family information to the App. You represent that you have the right to submit this information and that doing so does not violate another person's privacy or applicable law.
You retain ownership of content you submit. By submitting content, you grant us a limited license to host, display, and process it solely to operate and improve the App, in accordance with your visibility settings and our Privacy Policy.
Information about minors should be added only by a parent, legal guardian, or another authorized family member.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms.
- Impersonate another person or misrepresent your identity or family relationships.
- Upload content that is false, defamatory, harassing, or otherwise harmful.
- Attempt to access accounts, data, or systems you are not authorized to use.
- Interfere with or disrupt the App, including by introducing malware or automated scraping that overloads the service.
- Copy, reverse engineer, or commercially exploit the App except as permitted by law.
6. Intellectual Property
The App, including its design, software, logos, and original content (other than user-submitted family data), is owned by Vanshavali Bhatnagar or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our name, branding, or content except as needed to use the App.
7. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the App, you also acknowledge that policy.
8. Third-Party Services
The App may rely on third-party services such as hosting, analytics, authentication, or push notifications. Those services are governed by their own terms and privacy policies. We are not responsible for third-party services we do not control.
9. Disclaimer of Warranties
The App is provided "as is" and "as available." We do not warrant that the App will be uninterrupted, error-free, or completely secure, or that family tree information will be complete or accurate. Lineage data depends on what users submit. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the fullest extent permitted by law, Vanshavali Bhatnagar and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App shall not exceed the amount you paid us (if any) in the twelve months before the claim, or one hundred US dollars (USD $100), whichever is greater.
11. Termination
You may stop using the App and request account deletion at any time through the App settings or by contacting us. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the service. Upon termination, your right to use the App ends. Provisions that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) will survive.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and may notify you through the App, by email, or on our website. Continued use of the App after the effective date of changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless a mandatory law in your place of residence requires otherwise. Courts of competent jurisdiction in India shall have exclusive jurisdiction over disputes arising from these Terms, subject to any non-waivable consumer protections that apply to you.
